Data protection information for the Use of AI-Systems
At the University of Applied Sciences for Health Professions Upper Austria, the use of ChatGPT is possible under certain conditions (guideline for the use of AI applications at University of Applied Sciences for Health Professions Upper Austria). This AI system is a product of OpenAI OpCo, LLC based in the USA. For the EEA and Switzerland, the services are provided by OpenAI Ireland Ltd.
When using AI systems, dealing with data protection aspects is highly relevant. The use of ChatGPT requires the creation of a user account, whereby information and personal data are collected from you.
The settings are made platform-independent, i.e. they are applied to all devices, such as desktop computers or mobile devices.
The processing of your data is based on your consent pursuant to Art 6 paragraph 1 lit a of the GDPR.
ATTENTION: Within the scope of this service, data transfer to the U.S. takes place or cannot be excluded. We would like to point out that as of July 10, 2023, the European Commission has issued an adequacy decision pursuant to Art 45 paragraph 1 GDPR on the EU-US data privacy framework (Data Privacy Framework). Accordingly, organizations or companies (as data importers) in the U.S. that are registered in a public list under the self-certification option of the Data Privacy Framework provide an adequate level of protection for data transfers. Whether the specific provider of this service is already certified can be found here: https://www.dataprivacyframework.gov/s/participant-search
