With this information, the University of Applied Sciences for Health Professions Upper Austria informs you about the processing of your personal data on the occasion of your application for a study place.

The University of Applied Sciences for Health Professions Upper Austria, Semmelweisstraße 34, 4020 Linz is responsible for data processing in accordance with data protection regulations.

1. Implementation of the application process:

According to § 11 FHG (University of Applied Sciences Act), universities of applied sciences are obliged to first check whether the legal requirements for admission to a university of applied sciences degree program are met and to carry out an admission procedure based on this. In order to be able to process this legally, all data that you have provided yourself as part of the application, for example by uploading it to the applicant platform (in particular contact details, certificates, data on your CV, etc.), will be processed. In addition, the data that arises in the course of the admission procedure (results, written assessments, interview transcripts, etc.) will be processed. The legal basis is the pre-contractual relationship established by your application (legal basis: Art. 6 para. 1 b) GDPR).

In some study programs you will be asked to upload tasks to the learning platform of the University of Applied Sciences for Health Professions Upper Austria - Moodle - or to solve tasks directly on the learning platform. The following data protection guidelines apply in this case: Moodle is a technically secure platform whose content is stored by the certified IT service provider (processor) of the University of Applied Sciences for Health Professions Upper Austria. Applicants are created as "users" in the system and can upload content or complete tasks using their access data. These contents or tasks are only accessible to those persons at the degree program who need them to fulfill their official duties in the admission procedure. The technically necessary user data of the applicants will be deleted after the end of the admission procedure. The content that has been uploaded or entered will be deleted after the end of the storage period in point 4.

In some study programs, the "Microsoft Bookings" app is used for scheduling appointments. This app allows you to select the right appointment for you (e.g. for the admission interview) via a link sent to you by e-mail and by entering your name and e-mail address. The app is a product of Microsoft Ireland Operations Limited, which is a certified processor of the University of Applied Sciences for Health Professions Upper Austria. Data will not be transmitted to third parties, apart from technically necessary transmissions to Microsoft Corporation for the functioning of the app. Microsoft is contractually obliged to transfer the data to a third country only in exceptional cases of technical necessity for system maintenance. In such cases, standard contractual clauses are agreed for the transfer and technical (encryption of the data) and organizational (guidelines for securing use) security measures are taken or the adequacy decision pursuant to Art 45 (1) GDPR on the EU-US data protection framework of the European Commission is invoked. Accordingly, organizations or companies (as data importers) in the USA that are registered in a public list as part of the self-certification option of the Data Privacy Framework offer an adequate level of protection for data transfers.

The University of Applied Sciences for Health Professions Upper Austria bases this data processing on consent pursuant to Art. 6 para. 1 a) in conjunction with Art. 45 GDPR. If you do not wish to use the app for scheduling, you can also request free appointments during office hours from the respective assistants of the study programs.

For those parts of the admission procedure that take place via video conference, the University of Applied Sciences for Health Professions Upper Austria uses the software "Microsoft Teams", which is also a product of Microsoft Ireland Operations Limited and the above applies to "Microsoft Bookings". There will be no recording of the video conference. Only you, the head of the study program and a person with relevant expertise (usually a member of the teaching and research staff of the respective study program) will participate in the video conference. The University of Applied Sciences for Health Professions Upper Austria refers to the legal basis in Art. 6 para. 1 lit. b) in conjunction with Art. 45 GDPR for this data processing. The necessity for pre-contractual measures is based on the fact that the University of Applied Sciences for Health Professions Upper Austria is obliged under the FH-training regulations to check professional and health-related aptitude in the admission procedure. The personal interview and the assessment of small job-specific tasks, which can only be assessed well with images and sound, are suitable and indispensable means for this.

In accordance with the specific training regulations for health professions (in each case appropriate to the intended course of study), the professional and health aptitude required for practicing the profession must be checked during the admission procedure. The medical confirmation of health suitability and criminal record information provided by you for this purpose at the end of the admission procedure, as well as any data obtained in the course of the admission procedure, belong to the special categories of personal data. They are processed under special security precautions at the University of Applied Sciences for Health Professions Upper Austria (legal basis: Art. 6 para. 1 c) in conjunction with Art. 9 para. 2 i) GDPR).

There is no legal obligation for you to disclose your data for the admission procedure, but the aforementioned data processing is necessary for the decision as to whether a training contract can be concluded. Therefore, your application cannot be processed if you do not provide the requested data or refuse to provide it. Fields marked with * in the online application form are mandatory.

If you are offered a place, all data from the admission procedure will be transferred to your student file. Your application photo will be printed on your student ID card and may also be used for photo lists for course instructors. The University of Applied Sciences Act and the Education Documentation Act in particular provide a legal basis for further data processing during your studies. You will receive information about this before concluding the training contract.

2. Quality assurance of the admission process and research:

The University of Applied Sciences for Health Professions Upper Austria constantly seeks to improve the admission procedure. Therefore, the data collected in the course of the admission procedure is evaluated and stored pseudonymously for research projects to improve the quality of the admission procedure in accordance with § 7 para. 1 no. 2 DSG.

3. Recipient:

The University of Applied Sciences for Health Professions Upper Austria processes and stores all data with its certified IT service provider (processor), which provides the entire IT infrastructure used in all areas of the University of Applied Sciences for Health Professions Upper Austria.

In order to register you for the necessary examination for the professional aptitude for the speech therapy degree program, your first name and surname will be sent in advance to the health institution that will carry out the medical examination.

If you submit foreign certificates as proof of the legal admission requirements, these will be forwarded in justified individual cases to the responsible office in the Federal Ministry of Education, Science and Research and, if necessary, also to the Austrian embassy in the country where the certificate was issued or to the relevant university/school abroad in order to verify the qualification and to check the authenticity of the certificate. This transmission is a necessary measure to ensure the quality of the admission decision, in which the University of Applied Sciences for Health Professions Upper Austria has a legitimate interest pursuant to Art. 6 para. 2 f) GDPR. If the university/school is located in a country outside the European Economic Area (EEA), the transfer will only take place in exceptional cases and on the basis of an adequacy decision pursuant to Art. 45, or suitable guarantees pursuant to Art. 46 or for the implementation of pre-contractual measures pursuant to Art. 49 GDPR.

When you are admitted to study in Austria for the first time, the University of Applied Sciences for Health Professions Upper Austria is obliged to assign you a matriculation number in accordance with the Education Documentation Act. For this purpose, your personal data (e.g. names, addresses, gender, date of birth, school-leaving examination date) will be reported to the data network of universities, teacher training colleges and universities of applied sciences and you will be assigned a matriculation number from there, which you will keep throughout your entire study career. In the case of joint studies, it is also necessary for student fee data, study data and study success data to be reported to the data network.

4. Storage period:

If your application leads to the acceptance of a study place and the conclusion of a training contract, all data for the training relationship will continue to be processed. In this case, you will receive further information when the training contract is concluded.

If you are not offered a place, your personal data will be deleted three years after the end of the application process. The application documents that you upload and your social security number (if you have provided it) will be deleted 2 years after your application. The retention period is based on statutory retention obligations and the limitation periods for potential legal claims.

5. Rights of data subjects:

The controller for data processing is the University of Applied Sciences for Health Professions Upper Austria, Semmelweisstraße 34, 4020 Linz. Persons affected by the data processing have the right to information, correction, deletion or restriction of the processing of the stored data as well as a right to object to the processing at any time under the conditions of the data protection regulations.
